The term of this agreement shall begin on the date you register for our File(s) Hosting services OR upload a file via our service, and will continue as long as File Den is providing File(s) Hosting services for you.
File Den offer free file hosting services providing the user abides by the Terms of Service listed below.
(“We”) File Den have the right to terminate your account for any reason, at any time, without notice, at our discretion. We will not backup any of your files before termination, in the termination process all of your files are physically deleted. We also have the right to suspend your service at any time, for any reason, without warning.
We will put full effort into ensuring that your files and File Den are up twenty-four (24) hours a day, seven (7) days a week, three hundred and sixty five (365) days a year. This is not by any means a guarantee.
You deem yourself fully responsible for updating, managing, editing and generally owning any content in which you upload to File Den servers and take full responsibility for any files uploaded.
You agree that all content of which you upload you either have full responsibility to upload or own it yourself and that no content, materials, data, work, trade or service mark, trade name, link, advertising or services that actually or potentially violate any applicable law or regulation or infringe or misappropriate any proprietary, intellectual property or contract shall be uploaded and hosted on File Den servers.
You are also fully responsible for any extreme changes in server load brought on by your content uploaded, any mail bombs on the server or DDOS attacks brought to the server due to your uploaded file.
File Den has the right to remove files displayed on sites with any display of, affiliation with or links to illegal content. At all times you have full responsibility for all files and information hosted on File Den. You are completely responsible for the security of your account details and agree that you are fully responsible for any acts inside of your account.
File Den have full rights to terminate any account which is believed to be linked with unsolicited email / SPAM.
FILE DEN WILL IN NO WAY BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF GOODWILL OR PROFIT, FOR ANY MATTER, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT, OR OTHERWISE, EVEN IF FILE DEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
